What are the options for recruiting foreign workers without going through the LMIA process?<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-recruter-un-travailleur-etranger-exempte-d-eimt\">Hiring a foreign worker exempt from an LMIA<\/h2>\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>As a <strong>general rule<\/strong>, a Canadian employer must obtain a Labour Market Impact Assessment (LMIA) before hiring a foreign worker. However, certain exemptions do exist.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>They allow for simplified administrative procedures, shorter processing times, and lower costs for the employer.<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\" id=\"h-le-programme-de-mobilite-internationale-pmi\">International Mobility Program (IMP)<\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>In most cases, to hire a temporary worker under the International Mobility Program (IMP), the employer must create and submit a job offer through the IRCC Employer Portal. This is the federal immigration authority\u2019s online portal, which allows employers to complete various procedures.<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\" id=\"h-experience-internationale-canada-eic\">International Experience Canada (IEC)<\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Under this program, more than thirty nationalities are eligible. The applicant must be between 18 and 35 years old (or up to 30 years old depending on the country). Then, one or more types of permits are available depending on the applicant\u2019s nationality, each with specific eligibility criteria.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Three types of permits are offered under IEC:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Working <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/services\/work-canada\/iec\/eligibility.html?selection=fr-wh#selection\" target=\"_blank\" rel=\"noopener\">Holiday Permit<\/a> (WHP):<\/strong> an open work permit based on a lottery system.<\/li>\n\n\n\n<li><strong>Young <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/services\/work-canada\/iec\/eligibility.html?selection=fr-yp#selection\" target=\"_blank\" rel=\"noopener\">Professionals Permit<\/a><\/strong>: a closed work permit (tied to a single employer), available based on occupational criteria and aligned with the applicant\u2019s professional experience.<\/li>\n\n\n\n<li><a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/services\/work-canada\/iec\/eligibility.html?selection=fr-coop#selection\" target=\"_blank\" rel=\"noopener\"><strong>International Co-op (Internship)<\/strong><\/a>: a closed work permit for an internship as part of academic studies.<\/li>\n<\/ul>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>The program operates on a pool system, where the applicant registers until they receive an <a href=\"https:\/\/ircc.canada.ca\/english\/work\/iec\/selections.asp?country=fr&amp;cat=yp\" target=\"_blank\" rel=\"noopener\">invitation<\/a> to apply for a work permit.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Most of these permits <strong>are not renewable<\/strong> and generally have a <strong>maximum duration of 24 months<\/strong>. In addition, the program is <strong>seasonal<\/strong> and therefore not available year-round. Currently, the 2025 season is open.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p><strong>IEC permits<\/strong>, when the applicant is eligible, are an excellent option for employers. However, since these permits are non-renewable, any steps taken for renewal often require an LMIA.<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\" id=\"h-les-permis-delivres-sous-certains-programmes-specifiques\">Permits issued under certain specific programs<\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h4 class=\"wp-block-heading\" id=\"h-accords-de-libre-echange\">Free trade agreements<\/h4>\n\n<div style=\"height:15px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>These agreements, between Canada and various countries, may exempt the employer from requiring an LMIA, depending on the applicant\u2019s eligibility and the specific agreement in question.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Less well-known, LMIA exemptions under free trade agreements are actually quite numerous! Among the possibilities: exemptions for specific occupations, for intra-company transfers, for specialists\u2026<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Before resorting to an LMIA, exploring the possibility of benefiting from a free trade agreement, especially with the help of an <a href=\"https:\/\/immetis.com\/en\/contact-immigration-experts\/\" target=\"_blank\" rel=\"noopener\">immigration professional<\/a>, can be a winning strategy.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Among the most commonly used agreements for obtaining work permits:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>CUSMA \u2013 Canada\u2013United States\u2013Mexico Agreement<\/li>\n\n\n\n<li>CETA \u2013 Comprehensive Economic and Trade Agreement between Canada and the European Union<\/li>\n<\/ul>\n\n<div style=\"height:15px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h4 class=\"wp-block-heading\" id=\"h-mobilite-francophone\">Francophone Mobility<\/h4>\n\n<div style=\"height:15px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>This program allows <strong>French-speaking<\/strong> or <strong>bilingual<\/strong> temporary foreign workers to obtain a work permit outside Quebec, generally for a duration of <strong>24 months<\/strong>.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>To be eligible, the applicant must demonstrate their level of French and have a job offer outside Quebec. However, <strong>the job does not need to be performed in French<\/strong>.<\/p>\n\n<div style=\"height:15px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h4 class=\"wp-block-heading\">Quebec-selected skilled workers program<\/h4>\n\n<div style=\"height:15px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>The <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/services\/immigrate-canada\/quebec-skilled-workers.html\" target=\"_blank\" rel=\"noopener\">program<\/a> is reserved for foreign nationals who are in the process of applying for <strong>permanent residency in Quebec<\/strong>.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>In this context, encouraging your workers to pursue permanent residency is a strategy worth considering. The renewal of work permits for employees who are in the process of applying for permanent residence is facilitated, allowing employers to significantly reduce associated costs.<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\">Anticipated costs under the IMP<\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Regardless of the specific stream under the IMP, the costs associated with obtaining a closed work permit are outlined below. These amounts are current as of 2025.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p><strong>Payable by the employer:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>230$ CAD for the employer compliance fee<\/li>\n<\/ul>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p><strong>Payable by the employer or the applicant<\/strong>, depending on what has been agreed upon:<\/p>\n\n<p>\u2013 155$ CAD for a closed work permit application<\/p>\n\n<p>\u2013 179.75$ CAD for a Young Professionals or International Co-op (International Experience Canada) work permit application<\/p>\n\n<p>\u2013 85$ CAD for biometric data collection<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Naturally, professional fees may apply if the employer or the applicant chooses to retain the services of an immigration expert.<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\">Open work permit<\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>The <a href=\"https:\/\/ircc.canada.ca\/english\/helpcentre\/answer.asp?qnum=176&amp;top=17\" target=\"_blank\" rel=\"noopener\">open work permit<\/a> is one of the most <strong>flexible<\/strong> types, but also one of the least common. It allows an individual to <strong>work for any employer<\/strong> in Canada, <strong>in the position of their choice<\/strong>, with certain <strong>exceptions<\/strong>.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>For an employer, hiring a worker who holds an open work permit offers certain advantages. Notably, there are no administrative procedures required for the hire, other than ensuring the permit is valid. However, it is important to note that open work permits are rarely renewable. Therefore, it is often necessary to go through the LMIA process in order to renew the permit.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p><em>Who is eligible for an open work permit?<\/em><\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Open work permits are <strong>notably available to spouses<\/strong> of foreign workers or international students, provided they meet the eligibility criteria.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>For example, if a worker is employed in Canada under a closed work permit, their <strong>spouse may be eligible for a permit of equivalent duration<\/strong>. However, the worker must hold a skilled position and possess a valid work permit for at least 16 months at the time their spouse submits the application.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Consult the <a href=\"https:\/\/immetis.com\/en\/open-work-permit-for-spouse-who-can-still-benefit-from-it\/\" target=\"_blank\" rel=\"noopener\">recent guidelines<\/a> on the eligibility of open work permits for <strong>family immigration<\/strong> should you wish to obtain further information.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Additional categories of open work permits are outlined in the following sections.<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\">Post-Graduation Work Permit (PGWP)<\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>The <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/services\/study-canada\/work\/after-graduation\/eligibility.html\" target=\"_blank\" rel=\"noopener\">Post-Graduation Work Permit<\/a> allows eligible graduates to gain work experience in Canada.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Applicants are granted a period of up to 180 days following the conferral of their degree to submit their application.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>The validity period of the PGWP depends on the study program, its duration, and the expiration date of the applicant\u2019s passport.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Here as well, if the worker has not obtained permanent resident status before the expiration of their PGWP, it will likely be necessary to apply for an LMIA in order to obtain a new work permit.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>A fee of 255$ CAD is required for an open work permit.
