Employers must therefore navigate these requirements carefully in order to continue meeting their recruitment needs while remaining compliant.<\/p>\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-qu-est-ce-qu-un-poste-a-bas-salaire\">What is a low\u2011wage position?<\/h2>\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Under the TFWP, a position is considered &#8220;low wage&#8221; when the hourly wage offered is below the provincial or territorial median wage threshold. In Qu\u00e9bec, this threshold is set at $34.62\/hour. In Ontario, it is $36.00\/hour.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>This classification determines whether a <strong>Labour Market Impact Assessment (LMIA)<\/strong> application must be submitted under the high\u2011wage or low\u2011wage stream. The wage level also dictates the employer\u2019s compliance obligations.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>If the wage offered is below the median threshold, the employer must apply under the low\u2011wage stream, and vice versa.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Periodic increases in wage thresholds are reclassifying an increasing number of positions into the low\u2011wage stream, which impacts the renewal of work permits associated with an LMIA.<\/p>\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-l-eimt-nbsp-une-etape-incontournable-pour-les-postes-a-bas-salaire\">The LMIA: a mandatory step for low\u2011wage positions<\/h2>\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>To hire a temporary foreign worker under the low\u2011wage stream, the employer must obtain a positive or neutral LMIA.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>The employer must demonstrate that no Canadian citizen or permanent resident is available to fill the position. As part of this process, the employer must prove local recruitment efforts, including job advertising for at least <strong>30 consecutive days<\/strong> within the <strong>three months<\/strong> preceding the LMIA application, and continue recruitment throughout the LMIA processing period.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>In Quebec, the employer must also include a <strong>Quebec Acceptance Certificate (CAQ)<\/strong> with the LMIA application. Applications are submitted simultaneously to the <strong>Minist\u00e8re de l\u2019Immigration, de la Francisation et de l\u2019Int\u00e9gration (MIFI)<\/strong> and <strong>Employment and Social Development Canada (ESDC)<\/strong>.<\/p>\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-obligations-generales-imposees-aux-employeurs\">General obligations imposed on employers<\/h2>\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>To hire a low\u2011wage <strong>Temporary Foreign Worker (TFW)<\/strong>, employers must comply with several general requirements:<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<ul class=\"wp-block-list\">\n<li>The job offer must be full\u2011time, with a minimum of <strong>30 hours<\/strong> per week;<\/li>\n\n\n\n<li>The employer is responsible for <strong>round\u2011trip transportation<\/strong> between the worker\u2019s country of origin and the place of work, typically airfare;<\/li>\n\n\n\n<li>The employer must provide or facilitate <strong>access to<\/strong> suitable and affordable <strong>housing<\/strong>. Affordable housing refers to accommodation that is financially manageable for the worker based on their wage;<\/li>\n\n\n\n<li>The employer must provide <strong>private health insurance coverage<\/strong> from the worker\u2019s arrival in Canada until they become eligible for the provincial healthcare system (<strong>RAMQ<\/strong> in Qu\u00e9bec). This effectively makes it impossible to use the low\u2011wage LMIA stream in these regions.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>In addition, regardless of the LMIA type, companies with <strong>25 employees or more<\/strong> must comply with French\u2011language compliance requirements under the Charter of the French Language in order to obtain a positive or neutral LMIA.<\/p>\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-alternatives-pour-les-employeurs-face-aux-restrictions\">Alternatives for employers facing restrictions<\/h2>\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>When restrictions make it difficult to obtain a low\u2011wage LMIA, employers may consider alternative options.<\/p>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<ul class=\"wp-block-list\">\n<li>The <strong>International Mobility Program (IMP)<\/strong> allows employers to recruit foreign workers without an LMIA, under certain conditions;<\/li>\n\n\n\n<li>Employers may also hire workers who are already in Canada, including holders of open work permits, such as participants in <strong>International Experience Canada (IEC)<\/strong> on a <strong>Working Holiday Permit (WHP)<\/strong>. Employers may also recruit individuals on a pathway to permanent residence, such as holders of a valid Quebec Selection Certificate (CSQ);<\/li>\n\n\n\n<li>Increasing the offered wage may allow the position to exceed the median threshold and shift into the high\u2011wage stream. Employers must still ensure compliance with <strong>pay equity<\/strong> obligations and <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/immigration\/formulaires\/fr\/Embaucher_un_travailleur_temporaire\/Guide_Salaires_par_professions_Edition_2024.pdf\" target=\"_blank\" rel=\"noopener\">salary scales by occupation<\/a> (in Quebec). Under the high\u2011wage stream, the maximum work permit duration is <strong>36 months<\/strong>, offering a more stable timeframe for transitioning to permanent residence and reducing renewal costs;<\/li>\n<\/ul>\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Where feasible, employers may also consider changing the work location to a region not subject to restrictions in order to submit a low\u2011wage LMIA.
